Terms and Conditions
This is an agreement between you (“you”, “your”) and Mates4Mates Ltd ACN 160 646 999 (“Mates4Mates”, “us”, “we”, “our”)
1. Veteran & Family Wellbeing Centres
(a) You have approached us to access services at one of the Veteran & Family Wellbeing Centres managed by Mates4Mates (Centres). These Centres are multidisciplinary Centres which house multiple Ex Service Organisations (ESOs). The mission of these Centres is to ensure that no veteran or family member in the local area is left without the support they need to improve their quality of life.
(b) You understand that Mates4Mates may (but is not obliged to) contact you as part of the Centre’s health and wellbeing approach and to conduct a wellbeing check in.
(c) You agree that, at when you access services in the Centre, you will behave in a manner consistent with the Centre Rules, outlined in Annexure A.
2. Collection, use and disclosure of your Personal Information
(a) In order for you to access services within the Centres, we will need to collect and record personal information that is relevant to your situation, your access to the Centre and the services being requested. This includes information such as your name, contact information, service history and other relevant information which may include your health information. This information is being collected by Mates4Mates.
(b) If we identify that you may be interested in our other programs and/or services or the programs and services provided by our related entity, Returned & Services League of Australia (Queensland Branch) (“RSL Queensland”), we or RSL Queensland may use your information to contact you to discuss those programs and services.
(c) You do not have to give all your personal information, but if you don’t, it may limit the quality and type of services that you will receive.
(d) All personal information collected and recorded will remain confidential and secure, except where:
(i) the information is subpoenaed by a court; or
(ii) failure to disclose the information would, in our reasonable belief, place you or another person at serious and imminent risk to life, health or safety; or
(iii) your prior written approval has been obtained; or
(iv) you would reasonably expect your personal information to be disclosed to another professional or agency (e.g. your referring General Practitioner) and disclosure of your personal information to that third party is for a purpose which is directly related to the primary purpose for which your personal information was collected; or
(v) disclosure of your information is otherwise required or authorised by law.
(e) Mates4Mates may disclose your personal information overseas in certain limited situations, such as to service and technology providers located overseas, including in the United States. Our privacy policies provide further detail on such overseas disclosures.
(f) If we do disclose your personal information to an overseas recipient, they may not be subject to privacy laws that provide the same level of protection that is provided under the Privacy Act 1988 (Cth). However, we will take reasonable steps to ensure that the overseas recipient will handle and protect your personal information in the same way that that we are required to under the Privacy Act 1988 (Cth).
(g) When signing this form, please be aware that you are providing your consent for your personal information to be collected, used and disclosed in the manner set out above.
3. Consent to Disclose Information
(a) We have certain obligations to the Department of Veteran Affairs (DVA), in relation to reporting requirements for Veteran & Family Wellbeing Centres. Your information will be provided in such reporting from time to time in a deidentified and aggregate manner.
(b) As part of our services, we often collate client data with all other participant data, for analysis and research purposes. This analysis may be conducted by Mates4Mates, RSL Queensland and/or its approved research partners including NovoPsych, the secure database system used to store clinical data, and the Gallipoli Medical Research Foundation. Your information will be provided to our approved research partners from time to time in a deidentified manner.
(c) When signing this form, please be aware that you are providing your consent for this to take place.
4. Limitation of Liability
Except for any legal or regulatory requirements that cannot be excluded or limited, you agree that the following limitations on our liability will apply:
(a) Mates4Mates’ liability for any loss, damage, liability, costs or expenses (Loss) or any claim, demand, action, proceedings or judgment made or threatened (Claim) in connection with our provision of any services (including but not limited to social connection services) to you is limited as follows:
(i) we will not be liable to you for any Loss or Claim you suffer or incur for any reason as a result of us providing the services to you;
(ii) we will have no liability to any person other than you in relation to our provision of the services;
(iii) liability for any Claim or Loss is recoverable only from us and not from any of our members, employees, officers, representatives or agents;
(iv) our liability is limited to such proportion of the Loss or Claim as is just and equitable having regard to the extent of your own responsibility for the Loss or Claim and that of any other person (regardless of any inability to enforce a claim against such other person);
(v) we will in no circumstances be liable for any action, omission or services provided by an External Organisation.
(b) I release Mates4Mates from any claims or demands arising out of or in connection with my participation any services as well as any damage, loss, or expense howsoever caused which may arise as a result of my participation in any services;
(c) To the fullest extent permitted by law, our maximum liability to you under this agreement will not exceed the amount of the reasonable cost of providing the services to you again.
